Sales Policy

By placing an order with Harmsworth Townley Co. Ltd via our online ordering process, or by post, fax, e-mail, telephone or in person, you signal your agreement with the terms and conditions of sale herein.

No representative agent or salesperson has any authority to waive or vary any of these conditions on behalf of Harmsworth Townley & Co. Ltd and any suggested qualification of these terms and conditions shall be deemed to be excluded unless they have been submitted in writing and been signed by a director or secretary on behalf of Harmsworth Townley & Co. Ltd.

The minimum permitted age for the ordering of goods from this website is 18 years.

Placing an Order

By ordering goods via this website you are entering into a legally binding contract. UK law is applicable. When you place your order with Harmsworth Townley & Co. Ltd, you are making an offer to purchase the items you have selected and Harmsworth Townley & Co. Ltd reserves the right to accept or decline said offer. No binding contract will be created until the order has been accepted by Harmsworth Townley & Co. Ltd.

Harmsworth Townley & Co. Ltd shall be under no obligation to acknowledge receipt of an order from a purchaser and shall be entitled to execute the order without further reference to the buyer.

When placing an order online, you will be asked to provide your e-mail address for your convenience, so that, where possible, we may send you a confirmation of order e-mail, in addition to delivery status reports and update details relating to your order. Personal details will not be passed to any third parties for marketing purposes.

If you prefer not to receive future offers from us by e-mail, please select the ‘Please do not contact me’ option from the Promotional Material drop down box.

Before submitting your order, you will have the opportunity to correct any mistakes before you hit the ‘submit’ button. Once your order has been placed, you will receive an e-mail confirmation from us detailing the goods that you have ordered and that we have accepted your order subject to our terms and conditions. Should we refuse your order for any reason you will be duly informed. The total cost of your order will include the price of the goods ordered plus any applicable delivery charge. The full amount of your order, including VAT, will be shown clearly before you submit your order and authorise payment.

All purchases are covered by our seven-day exchange or money back guarantee (excluding any carriage charges incurred). Should you change your mind for any reason, please return the unused item(s) in their original unopened packaging to Harmsworth Townley & Co. Ltd, accompanied by the receipt/invoice and we will be pleased to exchange or refund. See our returns page.

Payment

All prices are in UK pounds Sterling and are exclusive of VAT at the current rate. Ownership of goods will not pass to the customer until full payment has been received. Online payment can be made securely via MasterCard, Visa, Switch, Solo or Maestro and by fax, post or telephone (where you will be able to speak to someone in person). We also accept cash, cheques (made payable to Harmsworth Townley & Co. Ltd), banker’s draft or electronic bank transfer. All payments are subject to validation checks and clearance, and where required, authorisation by the card issuer. Should the issuer of your payment refuse to authorise payment, we retain the right to cancel the order.

Payment by bankers draughts and electronic bank transfer will be subject to an administration charge of £25 per transaction

Availability

While we aim to hold all items in stock, there may be occasions where, due to unexpectedly high demand or delays from suppliers, that there may be occasional delays in the delivery of your order. Should this occur, you will be notified by telephone or e-mail.

All drawings, photographs, descriptive matter, technical data, dimensions, weights, power consumptions and so forth serve only as a guide to the general nature of the goods whether or not supplied with a quotation and tender. It is the customer’s responsibility to ensure that the components ordered are suitable for the required application. Harmsworth Townley & Co. Ltd offers its products for the buyer’s approval. For this reason, Harmsworth Townley & Co. Ltd is willing to provide data sheets where available, upon request. Sometimes product specifications may change and in such instances we will do our very best to inform you when placing your order. No guarantee is given or implied that goods will conform in absolute detail to the description or illustrations published.

Printing and Pricing Errors

We strive to ensure that all prices and descriptions displayed on the website are correct at all times and will always aim to correct any errors as soon as we become aware of them. However, we will only accept orders if there are no errors in the prices of the products ordered, as advertised on this website. Harmsworth Townley & Co. Ltd will not be held liable for any errors or omissions. In the event that a product is listed at an incorrect price due to a typographical error or incorrect pricing information received from suppliers, we have the right to refuse or cancel any orders placed prior to a contract being made.

Product Guarantees

Unless otherwise stated, all products carry a standard 12 month guarantee, providing they are used in accordance with the specification. Should your product fail to meet this period, please contact Harmsworth, Townley & Co. Ltd. If your product develops a fault within 7 days of receipt, we will generally exchange or refund the item, provided that it is in an ‘as new’ condition. This does not apply to faults caused by accident, neglect, misuse or misapplication, for which there will be no refund or exchange. This does not affect your statutory rights. If your purchase develops a fault after 7 days and within its 12 month guarantee period, we will organise a repair or exchange of the product free of charge (UK only). This does not apply to faults caused by weather damage, accident, neglect, misuse or misapplication, for which there can be no refund or exchange.

With the exception of that which is provided in S2 of the Unfair Contract Terms Act 1977 (liability for death or personal injury resulting from negligence), Harmsworth, Townley & Co. Ltd accepts no responsibility in any circumstances for any direct, indirect or consequential loss or damage, howsoever arising which the buyer may sustain in connection with the supplied, whether such goods are of the seller’s own manufacture or not.

Discontinued Stock

All products featured in the Discontinued Stock section of the Harmsworth, Townley & Co. Ltd website are sold on a first come, first served basis and are sold as seen (please note that some product packaging may be damaged). Returns of clearance lines will not be accepted unless the product is faulty or damaged. Should clearance lines not be available at the point of processing the order and subsequently the order value drops below the small order charge level appropriate to the delivery, charges will be applied.
